Terms

Payment for parts is strictly before despatch. Repair and restoration work on vehicles is payable within 7 days of receipt of invoice. Payment can be made by all major credit or debit cards; personal cheques are accepted up to the guaranteed limit (or cheque clearance on larger amounts); we also accept payment by bank transfer. Charges may apply. We do not accept charge cards. In the event that any payment is not received by its due date, then we reserve the right to charge interest on the late payment at the rate of 6% per annum above Bank of England base rate from time to time on the amount outstanding from the date it became due to the date received in full, calculated on a daily basis and in addition administration charges in the event that debt collection measures have to be taken. The timescale for carrying out and completion of repair or restoration work is not guaranteed. In advance of delivery of the vehicle to us the customer shall inform us in writing of any future dates where the customer requires use of the vehicle for our agreement. In the absence of agreement in writing time is not of the essence of the contract.

Prices

Goods and services will be invoiced at prices ruling at the date of despatch and the right is reserved to amend these without notice if necessary. All prices are in sterling.

Value Added Tax

Prices given exclude Value Added Tax (VAT) which will be shown on invoices as a separate charge at the rate specified by Government regulations at the Tax Point date.

Delivery

Carriage and packing to destinations in the UK and Northern Ireland are by Post/Road except where other arrangements have been agreed. Overseas consignments, guaranteed next-day delivery and despatch by other methods will be subject to an extra charge and are as advised. Please telephone before 2.00pm for goods to leave for next day delivery. Our vehicle collection and delivery service is limited to the UK mainland unless specifically agreed otherwise. A vehicle will always be delivered back to the collection address unless specific arrangements have been agreed with the company in advance.

Delivery Promises

We will use the most efficient method available to send your goods. For urgent orders, please contact our telephone sales staff who will be pleased to advise you. Any delivery times are estimates only and shall not be of the essence. No Representations: we shall provide the customer with goods and services on the terms set out in any written order and in accordance with these terms and conditions. No other terms, representations, promises or statements, whether written or oral, shall apply or be incorporated into this contract. Collection: customers may collect their orders from Red Triangle; prior notice is appreciated so orders can be made ready for collection.

Examination of Goods

In the event of any discrepancy or damage in transit, it is essential that you sign the carrier’s delivery note “contents unexamined case damaged” and to examine the goods at once, advising the carriers and Red Triangle of any shortage within 3 working days.

Overseas Orders

When ordering from abroad you must provide us with correct details of your car – model type, year, car number, chassis number, LH or RH drive. Overseas orders are subject to local import duty and customs clearance, which will need to be paid by you at the point of entry.

Exchange Units & Surcharges

Certain items are available on an exchange basis; that is, your old unit must be returned to us for reconditioning. If an old unit is not returned to us at the time of ordering, a deposit surcharge is payable. Upon receipt of the old unit the surcharge will be refunded provided the returned unit is of a recondition-able quality. Some units are offered only as customer own-unit rebuild due to rarity. Special Orders

We can often supply special parts for Alvis cars which are non-stock items; a 50% non-refundable deposit when placing the order is required.

Back Orders

Whilst we aim to keep sufficient quantities of all items in stock, there are occasions where we exhaust our stocks; if we are unable to supply any item at the time of ordering, it will be placed on back order and supplied when available.

Non-Delivery or Shortage of Goods

Customers are responsible for advising us and the carriers of the non-delivery of goods within 10 days of the advice note, failing which no claims for shortage can be entertained. Return of Goods: all goods ordered and supplied correctly by Red Triangle are subject to a minimum 15% re-stocking charge and accepted as returns at our discretion. Special orders cannot be returned for credit unless faulty.

Liability for Defective Goods

Subject to the Terms and Conditions referred to below, our components are supplied to you with a benefit of the following warranty periods from the date of supply :

  • New parts – 12 months
  • Reconditioned parts – 6 months
  • Service Parts – 3 months
  • Second Hand parts – 1 month

The Terms and Conditions of the warranty periods are that you must, before having any work carried out to the vehicle or the alleged defective component:

  2. 2. Allow us to arrange free collection of your vehicle (normally within 7 working days) for an inspection in our workshops.

Upon proof of purchase and in the unlikely event that the component is found to have been defective in material or workmanship, we undertake to replace or repair the component free of charge, which shall be the limit of our liability to you. Our warranty does not cover third party labour costs, failure of the component arising from defective related components or defective installation or misuse of the component itself. Our warranty is personal to you and must not be assigned. The warranty will only apply to a component fitted to a vehicle that is used for social and domestic purposes only and excludes any defect arising in a vehicle used for competition, speed trials or similar use. Further, so far as may be permitted by law, we shall not under any circumstances whatever be liable for any indirect or consequential loss arising out of, under or in connection with any defect in any component supplied to you.

Application

Goods are only supplied for their specific application and for the purpose for which they were originally designed. Other than defective goods, no liability is accepted for subsequent fitting and application. In particular we will not accept any liability for loss or damage to any parts supplied by us caused or contributed in whole or part by or during their fitting or removal (save where carried out by us) or their modification nor for any loss or damage to associated parts or items howsoever caused.

Specification

In accordance with our policy of continuous improvement, we reserve the right to alter the specification of any of our products at any time.

Risk and Reservation of Title

The goods shall be at the customer’s risk as from delivery. Title to goods supplied shall not pass to a customer until payment has been made of the full contract price and no other sums whatever are due from the customer. Until title in the goods passes to the customer, the customer shall hold the goods and each of them on a fiduciary basis as our bailee and shall store them (at no cost to us) separately from all other goods in the customer’s possession and marked in such a way that they are clearly identified as our property and shall not incorporate the goods into or with any other goods or materials and shall keep them insured. Any sale of or dealing with the goods shall be a sale of or dealing with our property by the customer on the customer’s own behalf and the customer shall deal as principal when making any such sale or dealing. Until title in the goods passes from us the entire proceeds of sale or otherwise of the goods shall be held in trust for us and shall not be mixed with other money or paid into any overdrawn bank account and shall be at all material times identified as our money.

We shall be entitled to recover the price of the goods (plus VAT) notwithstanding that title in them has not passed to the customer.

Until such time as title in the goods passes from us to the customer, the customer shall upon request deliver up the goods to us. If the customer fails to do so, we may enter upon any premises owned, occupied or controlled by the customer where the goods are situated and repossess the goods.

The customer shall not pledge or in any way charge by way of security for indebtedness any of the goods, which are our property. Without prejudice to our other rights, if the customer does so all sums whatever owing by the customer to us shall forthwith become due and payable.

Insurance & Damages

We carry insurance under a full motor trade policy. This covers loss or damage to your vehicle resulting from our negligence only. All other risks must be covered by your existing policy, which you should keep in force throughout the period your vehicle is with us, to the value agreed with your insurer. If your vehicle suffers loss or damage whilst in our custody or under our control, our liability shall be limited to the proceeds of our insurance cover in that regard.

Repair & Restoration

Given the nature and possible longevity of repair and restoration projects, detailed information about work carried out and parts fitted (including photographs where appropriate) is gathered during the course of the month and a corresponding invoice raised for that month’s work & parts. This invoice will normally reach you by the 18th of the following month.

Please note that if your vehicle is returned to you part way through a month, it will not always be possible for us to raise a final invoice to accompany the vehicle – whilst every effort will be made to do so, it is possible that your final invoice will be produced in the standard end of month procedure and forwarded to you as soon as possible thereafter. Each invoice is payable in its own right; we do not invoice cumulatively. Payments received will be applied to the oldest outstanding amount first.

Red Triangle does not operate a credit account system for customers; we require payment of each monthly invoice within seven days of its receipt. We do however realise the importance to customers of having an opportunity to review work carried out and charges levied before making payment. It is therefore essential that you review your itemised invoice immediately on receipt so that, in the event you do have any queries either on the work we have done or the invoice itself, you can contact us within the seven day payment period, allowing us to respond appropriately.

Any queries on the invoice itself will be dealt with promptly and any adjustments made as appropriate. Any queries on work carried out will be investigated within timescales which we will agree with you. Please ensure that your invoice is settled within the terms above. In the event we are required to correspond with you about an outstanding account, we reserve the right to apply an administrative fee of £50 plus VAT per letter to your account.

Where arrangements have been made to deliver (or collect from our premises) a vehicle, and through no fault of ours the customer postpones the arrangement, the customer must accept an alternative date within fourteen days of the original date, otherwise we are entitled to impose a storage charge of £15 (plus VAT) for each day thereafter until delivery or collection from our premises.

Similarly, where an estimate for work has been issued, it must be accepted or declined within thirty days of the date of receipt of estimate or we are entitled to apply a storage charge of £15 (plus VAT) for each day thereafter until a decision has been received in writing. The company reserves the right to change the storage charge without notice. We shall have a lien over any vehicle or parts in our possession belonging to a customer from whom sums are due to us but are unpaid. Ultimately we shall have the right to dispose of the vehicle or any parts to recover sums owed to us in accordance with the Torts (Interference with Goods) Act 1977.

Force Majeure

We shall not be liable for any delay or failure to deliver any goods or perform any services arising out of any cause beyond our reasonable control.

Please also read carefully the warranty section below:

General Warranty

Please see the “Liability for Defective Goods” section on the warranty of our parts, which applies to any parts fitted in the course of repair or restoration. The warranty period on labour related to the fitting of those parts runs for the same period as the warranty for the parts themselves. It is the customer’s obligation to return the vehicle to our workshops for inspection and validation of any warranty work. Warranties are only valid when all outstanding monies have been paid in full. Any non-payment or withholding of part payment will make all warranties null and void.

The warranty period on bodywork repairs, particularly paintwork, carried out to your vehicle applies to bare metal repairs or new panels only. Warranty cannot be offered on paintwork applied to spot repairs.

Please note that the warranty period starts at the point at which we inform you that your vehicle/work is ready for collection by you/ delivery by us.

We are confident of the high standards of our workmanship. However, we recognise that there could be an occasion where our warranty is called upon. In the event that you are dissatisfied with any aspect of the work we have carried out for you, please inform us without delay. Please note that in the event you authorise any restorer other than Red Triangle to carry out rectification work, your warranty with Red Triangle becomes null and void and the costs of any such rectification remain with you.

With all claims, a copy of the purchase invoice must be produced. Any warranty or guarantee for goods or services is only valid with the original purchaser and cannot be transferred or assigned to a third party.

CONDITIONS OF RED TRIANGLE EXTENDED WARRANTY ON BODYWORK AND ENGINE REBUILDS

Our three year extended warranties are strictly subject to the following terms and conditions in addition to our general terms and conditions stated above:

Re-paint

The vehicle must be returned to us (at your expense, and upon payment to us of the inspection fee advised to you at the time) at least once in every period of twelve months during the life of the warranty, in order to enable us to check the condition of the paint and bodywork and provide the opportunity to carry out a detailed inspection. The vehicle must not be subjected to any exceptionally adverse weather or temperature conditions.

Engine Rebuild

The vehicle must be returned to us for an initial service after 500 miles or after the first twelve months, whichever is sooner. Red Triangle will collect and deliver your vehicle free of charge (mainland UK) for this initial service – you will only be charged for the parts and the labour. After 2000 miles or twelve months for the following two years it must be returned to us for service which will be charged at the prevailing rates for a standard service. This covers the life of the warranty and enables us to check the condition of the engine and provides the opportunity to carry out any adjustment. The engine must not be subjected to any exceptionally onerous handling or treatment, for example competition driving, wear or neglect or excessive mileage. The warranty does not cover wear and tear generally or the replacement of any consumable parts.

Please note that these terms and conditions supersede any previously published terms and conditions and that Red Triangle reserves the right to modify or amend them as and when appropriate.

These Terms and Conditions are not intended to nor shall limit the rights provided for in the Consumer Rights Act 2015.
